25 Years Old Motion On notice Comes Up For Hearing August 17

The National Industrial Court, Abuja, has fixed Aug.17 for hearing the motion on notice, filed by Mr Daniel Makolo of the Nigeria Immigration Service (NIS), seeking elevation to the rank of Deputy Comptroller-General of Immigration.

Makolo, a Chief Superintendent in the NIS, sued the Service over alleged denial of promotions since 1992.

The NIS officer also joined the Civil Defence, Fire, Immigration and Prisons Services Board (CDFIPB) as well as the Comptroller- General of NIS, as co-respondents.

The judge, Justice Rakiya Haastrup, fixed the date to enable claimant’s counsel, Mr Isaac Ebikwo, to respond to the issues raised by the respondents.

She also held that hearing of all pending applications would be taken on the adjourned date, by the next vacation judge.

The court, however, held that the preliminary objection filed by the respondents would be taken at the discretion of the vacation judge on Aug.17.

The News Agency of Nigeria (NAN) reports that the court had on July 19, restrained the NIS from conducting any promotion exercise, pending the hearing and determination of the suit filed by Makolo.

It also ordered parties to maintain the “status quo ante”, pending the determination of the case, and adjourned the case until Aug.2 for hearing of the motion on notice.

The NIS was represented in court by S. Amon, while Shola Olatunde, represented the CDFIPB the second respondent in the suit.
