Court Of Appeal Says President Jonathan Is Qualified To Contest 2015 election
A chieftain of the ruling Peoples Democratic Party, Chief Cyriacus Njoku has dragged President Goodluck Jonathan before an Abuja High Court seeking his disqualification on account that he had already taken oath of office for the same office in 2010 and 2011. After the Federal high court dismissed the case, the plaintiff went on appeal.
Now the court of appeal which had a five man panel lead by Justice Abubarkar Yahaya in a unanimous decision said that President Jonathan is qualified to seek another term in office having not participated in the previous two elections for the office as prescribed by law.
The court of appeal held that the oath of office taken by President Jonathan on 2010 to complete the term of Late President Umaru Musa Yaradua’s term was not on account of election required by law but by operation of the constitution. With this judgement, the legal coast may now be said to be clear for President Jonathan’s second term contest
